1. About this website

This website, fjord.com.au and its subdomains (Website), is operated by Fjord Wellness Pty Ltd ACN 662 905 982 as trustee for the Fjord Wellness Unit Trust, trading as “Fjord”, “Fjord Ice Baths” and “Fjord Wellness” (Fjord, we, us). 

We design and manufacture cold-water wellness products, including but not limited to ice baths, ice showers and chillers. By using the Website you agree to these Terms of Use.

2. Purchases are governed by our Terms of Sale

Any purchase of products or services from Fjord is governed by our Terms of Sale [link], not by these Terms of Use. For website orders, your order confirmation together with the Terms of Sale forms your agreement with us. If there is any inconsistency between Website content and the Terms of Sale, the Terms of Sale prevail.

3. Website content is general information only

Content on the Website is general information provided in good faith. In particular:

3.1 Health, benefits and cold or heat exposure. Nothing on the Website is medical advice. Articles and educational material about cold or heat exposure describe general concepts and research; individual responses vary, and any wellbeing benefits are not guaranteed. Our products are wellness and recreation products, not medical or therapeutic devices. Consult a health professional before beginning cold or heat exposure, especially if you have any medical condition.

3.2 Pool compliance and water treatment. Any guidance we publish about pool safety, barriers, commercial pool requirements, sanitisation, circulation systems or water treatment is general direction based on typical requirements at the time. We are not the authority on these matters: laws, standards and policies vary from state to state and council to council, and they update over time. Verify requirements with your pool safety certifier, health authority and local council before you rely on anything here.

3.3 Building and installation compliance. Any guidance we publish about installation, site preparation or building works is general product information, not building, engineering, electrical or plumbing advice for your site or facility. Requirements vary by state, council and site, and change over time. Your licensed trades must verify all site-specific design, installation and compliance decisions.

3.4 Product images, configurator and models. Product images are illustrative. Our online configurator, 3D models and photorealistic renders are indicative visualisations only: confirm physical dimensions against the current datasheet before designing or building around them, and colours and finishes may differ from any on-screen rendering.

3.5 Product Guides are the source of truth. Each of our primary products has a Product Guide available on its product page. It is the most up-to-date document for that product and the authoritative source of specifications, site requirements and safety information; read it in full before purchasing. We endeavour to keep Website content current and accurate, but errors and omissions can occur; product specifications, pricing and availability are confirmed in your quote or order confirmation, which prevail over Website content.

4. Information from others

Statements about our products made by anyone other than us (for example suppliers, retailers, installers, gyms, influencers, content creators or other owners, among others) are not made on our behalf and do not bind us unless we confirm them in writing. Our Website and Product Guides are the authoritative source about our products.

5. Safety information

Cold-water immersion or exposure is intense and carries real risks, including cold shock, fainting, hypothermia and drowning. Never use an ice bath alone; supervision is required for every use. No breath-holding; no head submersion; no diving, jumping or reckless behaviour. Persons under 18 require direct parental or guardian supervision and consent. Consult your doctor before use if you have heart, circulatory, respiratory, neurological or metabolic conditions, uncontrolled hypertension, Raynaud’s, epilepsy or a history of fainting, or if you are pregnant. Full usage precautions are in each Product Guide, available on the product pages, and must be read before first use. Our products are wellness and recreation products: they are not medical or therapeutic devices and are not intended to diagnose, treat, cure or prevent any condition.

6. Intellectual property

All content on the Website, including text, graphics, logos, trade marks, product designs, images, videos, the configurator, 3D models, renders and software, is owned by or licensed to Fjord. You may view and print Website content for personal, non-commercial use, and you may download 3D models we make available for use in your own project involving our products. You must not otherwise reproduce, modify, distribute or commercialise Website content, reproduce our product designs, or reverse-engineer our products or models for manufacture, without our written consent.

7. Accounts and purchases

If you create an account, keep your login details secure and your information accurate and current; you are responsible for activity under your account. You must be at least 18 to purchase from the Website. Promotions and discount codes are subject to their stated conditions, and we may correct or withdraw a promotion published in error.

8. Content you submit

If you submit content to us or the Website (for example reviews, photos of your installation, or comments), you grant us a non-exclusive, royalty-free licence to display it on the Website and confirm you have the right to share it. We may decline or remove submitted content at our discretion, and we will seek your consent before using your content in advertising attributed to you.

9. Acceptable use

You must not misuse the Website, including by attempting unauthorised access, introducing malicious code, scraping content at scale, interfering with the Website’s operation, or using it for unlawful purposes. We may suspend or restrict access to the Website where reasonably necessary to protect the Website, other users, or to comply with law. We will not exercise this right to avoid obligations we owe you under a contract of sale.

10. Third-party links

The Website may link to third-party sites (for example, payment providers and component manufacturers). We are not responsible for their content or practices.

11. Privacy and cookies

We handle personal information in accordance with our Privacy Policy at fjord.com.au/privacy and the Privacy Act 1988 (Cth). The Website uses cookies and similar technologies as described in the Privacy Policy.

12. Liability

Nothing in these Terms of Use excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or other law that cannot be excluded. Subject to that: the Website is provided “as is” and “as available”; and to the maximum extent permitted by law, we are not liable for loss arising from Website interruption or errors, or from reliance on Website content contrary to sections 3 to 5, and where liability cannot be excluded but can be limited, our liability is limited to resupplying the relevant information or services.

13. Australian audience

The Website is operated from Australia for Australian customers. We make no representation that Website content complies with the laws of any other country, and product certifications and specifications are stated for Australia.

14. General

We may update these Terms of Use from time to time; the version published at the time of your use applies. These Terms of Use are governed by the laws of Queensland, Australia, and the parties submit to the non-exclusive jurisdiction of its courts. If any provision is unenforceable it is severed and the remainder continues.
